A New England state judge is recommending against a federal jury's verdict that could throw out Pfizer's patents on the medicine Viagra, made by the maker of the erectile dysfunction drug.
The case was brought by a man who claims that he was taking the drug after the patent on the drug expired. He says the FDA is not aware of any studies that showed Pfizer's Viagra could be effective and has not been linked to any deaths.
The case follows an earlier case in which a man was sentenced to four years in prison for taking Viagra. He claims that his case was based on "too little" evidence, but that he was nonetheless not taking a drug that could cure erectile dysfunction.
Judge David Malinowski of the state's appeals court in Jacksonville, Florida, agreed with the jury's decision to sentence him to four years.
In the opinion, Malinowski said his opinion is based on the fact that the FDA has not linked the drug's use to an increased risk of death. He said the drug had been approved for use in more than one million men.
